The city of Norman and the Norman Tax Increment Finance Authority filed two motions to dismiss three of the five claims in the lawsuit brought by Oklahomans for Responsible Economic Development over the Rock Creek Entertainment District TIF, a suit filed June 23 against the city, NTIFA, the Cleveland County Recreational and Entertainment Facilities Authority, and developer UNP North LLC, alleging violations of the Oklahoma Constitution, the Local Development Act, and the Open Meetings Act, and challenging up to $600 million in taxpayer funding tied to the district. Notably, the two claims the motions do not attempt to dismiss are the procedural core of ORED's case: that the city failed to adopt a project plan in accordance with the Local Development Act, and that it failed to follow the Act's statutory review-committee mandates. Those are the claims that, if they survive, could actually unwind the district's legal foundation rather than simply narrowing the litigation.
